The Missouri Attorney General's Military Legal Assistance Team
What are the Legal Protections for a Guard/Reserve Servicemember?
- USERRA encourages military service by minimizing civilian employment problems resulting from such service, and prohibits discrimination and acts of reprisal against those who serve in the uniformed services. An employer, regardless of size,
may not deny a person initial employment, promotion, or any benefit of employment because the person performed or is obliged to perform service in a uniformed service.
- USERRA applies to private employers, state and local governments, and the federal government.
***Note: For details on legal protections available for members of the Civil Air Patrol and the U.S. Coast Guard, please refer to sections 41.1000 (Civil Air Patrol) and 41.1005 (Coast Guard) of the Revised Statutes of Missouri (RSMo).
