Environmental Protection and the AGO

The Agriculture and Environment Division aggressively protects Missouri's natural resources. Attorneys take legal action to stop pollution of the state's air, water and soil through injunctions, fines, penalties and in the most serious cases, incarceration.

Division attorneys represent the Department of Natural Resources and its constituent boards and commissions that regulate the use of the state's air, land and waters. The division is responsible for over 400 active enforcement cases, including administrative appeals before the DNR's commissions.

Enforcement litigation is filed primarily in state courts to seek preliminary and permanent injunctions to ensure compliance with Missouri's environmental laws.

The division obtains civil penalties for the state and recovers costs and damages for the DNR. Since 2008, the division has obtained over $6 million in civil penalty judgments.

AG Hawley Urges EPA to Return Authority to States and Local Governments

Jefferson City, Mo. (March 7, 2017) – Attorney General Josh Hawley today asked the Environmental Protection Agency to reevaluate its regulatory authority over states and localities. Hawley joins Texas Attorney General Ken Paxton and eighteen other Attorneys General in requesting EPA obey federal law and return authority to states and local governments. AG Josh Hawley Files Lawsuit Against President Obama’s Unlawful Land Regulations

Jefferson City, Mo. (February 7, 2017) - Attorney General Josh Hawley announced today that Missouri has filed suit challenging Obama Administration rules that drastically expand federal power over farm and ranch land across Missouri and the nation. The rules in question expand the definition of “critical habitat” for endangered and threatened species. Missouri joins 19 other states in the suit filed in the U.S. District Court for the Southern District of Alabama against the U.S. Secretary of the Interior, National Marine Fisheries Service, U.S. Secretary of Commerce and U.S. Fish and Wildlife Service. AG Hawley Sues Obama Administration to Protect Missouri Energy

Jefferson City, Mo. (January 19, 2017) - Attorney General Josh Hawley today announced that Missouri has sued the Obama Administration over regulations that will drive energy costs up for Missouri families.
