Dear Representative Sivils:

This letter is in response to your opinion request asking whether a hospital district organized under the provisions of Chapter 206, RSMo, is authorized to sell the district's real property which consists of the former hospital and site, the district having acquired a new hospital on a different site.

Your question is answered by our Opinion No. 531, dated November 19, 1970, to Bollow, copy enclosed, in which we held that a nursing home district created under Sections 198.200 to 198.350, RSMo, does not have the power to sell real estate purchased by it in the absence of express legislative authority. Both districts possess like powers but neither has the express power to sell such property.

Therefore, a hospital district organized under Chapter 206 does not have the power to sell the district's real estate.
