Attorney General Koster sues Greene County business for solid waste violations

Jefferson City, Mo. – Attorney General Chris Koster has filed a lawsuit against Bryan Weldon and Weldon Contractors and Construction, LLC, for violations of the Missouri Solid Waste Management Law and the Cave Resources Act.

Koster alleges that Weldon and his company, Weldon Contractors and Construction, LLC, illegally dumped approximately 100 cubic yards of demolition waste from tornado-damaged Joplin structures into an abandoned mine shaft near Neck City in Jasper County, where the waste could reach surface or groundwater. In addition, Weldon violated the Missouri Cave Resources Act when he illegally introduced solid waste into subsurface waters of the state through the mine shaft.

Koster is asking the court to issue a preliminary and permanent injunction prohibiting Weldon and his company from any further violations of the Solid Waste Management Law and the Missouri Cave Resources Act. Koster is also asking the court to assess a civil penalty up to $1,000 per day and court costs against Mr. Weldon and his company.

"Missouri’s natural resources are important to this state and must be protected,” Koster said. “No one should be allowed to use a mine shaft as an illegal dump, and those who abuse the environment in this way will be prosecuted."
