Attorney General Koster reaches settlement with McMullen Auto Credit, LLC, and its owners

Jefferson City, Mo. – Attorney General Chris Koster today announced that he has reached a settlement with McMullen Auto Credit, LLC, and its owners Nikki Darlene McMullen, Jamie McMullen, Sr., and Jamie McMullen, Jr.

Under the terms of the agreement, the McMullens are prohibited from ever again owning or operating an automotive dealership or an automotive wholesale business in the state of Missouri. In addition, the McMullens must offer to re-purchase six vehicles for which they never delivered good title and to refund the total amount of the consumers’ down-payments, trade-ins, and installment payments. In addition, the agreement requires the McMullens to pay $7,210.00 in restitution and $12,500 in fines, penalties, and costs to the state of Missouri.

The settlement resolves allegations that the McMullens were, among other things, failing to provide titles to customers; failing to provide car warranties promised to and paid for by customers; issuing multiple temporary permits for the same vehicle in violation of Missouri law; and making unlawful threats of repossession. Shortly after the Attorney General filed suit against the McMullens in December 2011, they decided to close their doors permanently.

“There are clear laws in Missouri to protect buyers of used vehicles,” Koster said. “When these laws are violated we will act aggressively to stop the violations and seek restitution for those harmed.”
