Attorney General Koster sues St. Charles man for underground storage tank violations

Jefferson City, Mo. - Attorney General Chris Koster today filed suit against Gerald Rohe, of St. Charles, for violations of Missouri's Underground Storage Tank (UST) Law.

Koster said Rohe owns Liberty Harbor Marina located off the Mississippi River in Portage Des Sioux in St. Charles County. There are two underground storage tanks at the Marina. Koster said Rohe has failed to close at least one of the tanks that has been damaged and has failed to maintain corrosion protection and release detection systems, in violation of Missouri law. In addition, the vent line to one of the tanks was cracked where it connects to the tank, allowing water to enter the tank when the river rises.

Koster said he filed the lawsuit after Rohe failed to respond to correspondence from either his office or the Department of Natural Resources (DNR). He is asking the court to issue a preliminary and permanent injunction ordering Rohe to immediately bring the site into compliance with Missouri law, and to pay a civil penalty of up to $10,000 per day for each violation of the law, and to pay all court costs and fees associated with the action.

"Underground storage tanks that are not in compliance with the law can pose a serious health threat to Missourians," Koster said. "This legal action is necessary because the defendant failed to voluntarily comply with the law even though given ample opportunity to do so."
