Nixon obtains temporary restraining order against California business over No Call violations

St. Louis, Mo. — A business based in Santa Ana, Calif., that repeatedly contacted Missourians on the state No Call list has been ordered to stop doing so immediately, due to a temporary restraining order obtained today by Attorney General Jay Nixon. St. Louis City Circuit Judge Edward Sweeney signed the order against Smart Funding Corp, which does business as AMR Fundings, and its owner Madhulika Baid.

Nixon filed a lawsuit against Smart Funding Corp after his office received numerous complaints from consumers about receiving unwanted telephone contact from the defendants, who were selling goods and services related to mortgage refinancing. A hearing for a preliminary injunction against the defendants will be on March 25.

In addition to seeking injunctive relief, Nixon is also requesting that the defendants establish policies and procedures that ensure future compliance with Missouri’s No Call law, and that they are required to pay appropriate civil penalties and all court costs in the case.
