Nixon agreement with St. Louis insurance company over No Call violations nets state $65,000

St. Louis, Mo. — A St. Louis company that called Missourians on the state No Call list to sell insurance-related goods and services will pay $65,000 to the state and develop policies and procedures that ensure future compliance with the law under an agreement with Attorney General Jay Nixon. Nixon’s assurance of voluntary compliance with Haberstroh Insurance Agency was filed today in St. Louis City Circuit Court.

In addition to having pay $65,000 to the state, the defendant must also implement policies and procedures to ensure future compliance with the law, including:

  • Maintaining postcards from consumers who have granted permission to the defendants to contact them by phone for a period of one year;
  • Maintaining an updated list of Missouri residential telephone numbers on the state and federal No Call lists, as well as those who have informed the defendant that they do not wish to be called, and not contacting any of those consumers for a period of five years;
  • Establishing and implementing a training program to educate its employees in how to make telephone solicitations without violating state consumer protection laws.

Today’s settlement also includes the stipulation that Haberstroh Insurance Agency pay $2,000 should it violate any term of the agreement resulting in contempt of court proceedings, and $5,000 for any future violations of Missouri consumer protection laws.
