Pharmacist Ordered to Repay $125,000 to Missouri’s Medicaid Program

Jefferson City, Mo. - Missouri Attorney General Eric Schmitt announced that Steven Baraban, pursuant to a plea agreement, was sentenced in the U.S. District Court for the Western District of Missouri to 3 years probation and ordered to repay Missouri’s Medicaid program $125,102.50. Baraban’s sentencing follows his March 1, 2019, guilty plea to one count of health care fraud.

“When individuals like Steven Baraban rig the Medicaid system for unlawful personal gain, our elderly and sick are the most adversely affected,” said Attorney General Schmitt. “As Missouri’s Attorney General, it’s my duty to bring those responsible for defrauding Missourians to justice. This result should send a clear message to those who seek to manipulate the Medicaid system to enrich themselves: we will hold you accountable for your actions.”

Baraban was a director and managing partner of Howard Stark Pharmacy, Inc. (Stark Pharmacy) and the pharmacist in charge of Stark Pharmacy’s Brookside location in Kansas City, Missouri (Brookside location).  The Brookside location that Baraban ran billed Medicaid, between September 9, 2014 and December 18, 2015, for $119,939.81 in compounded pain creams and $5,162.69 in Zyvox on June 16, 2015, that Medicaid recipients did not receive.

Pursuant to the plea agreement, Baraban was sentenced to 3 years probation, ordered to pay $125,030.50 in restitution, and surrender his pharmacy license.

The case was prosecuted by Assistant U.S. Attorney Cindi S. Woolery and Special Assistant U.S. Attorney Shannon Kempf of the Missouri Attorney General’s Office.

It was investigated by the United States Department of Health and Human Services, Office of Inspector General, the United States Federal Bureau of Investigation, and the Missouri Attorney General’s Medicaid Fraud Control Unit.  The Missouri Department of Social Services, Medicaid Audit and Compliance Unit assisted in the investigation.
