What are the Legal Protections for a Guard/Reserve Servicemember?

Uniformed Services Employment and Reemployment Rights Act (USERRA), 38 U.S.C. §§ 4301–4335

  • USERRA encourages military service by minimizing civilian employment problems resulting from such service, and prohibits discrimination and acts of reprisal against those who serve in the uniformed services.  An employer, regardless of size, may not deny a person initial employment, promotion, or any benefit of employment because the person performed or is obliged to perform service in a uniformed service.
  • USERRA applies to private employers, state and local governments, and the federal government.
