Nixon files suit to stop subdivision from discharging untreated sewage into tributary of Lake Taneycomo

Attorney General Jay Nixon today took legal action to stop the discharge of untreated sewage from a residential subdivision into a tributary of Lake Taneycomo. Nixon filed a lawsuit against the Damsite Improvement Association, which owns and operates the wastewater treatment facility that serves the Damsite Subdivision. The subdivision, which contains approximately 10 lots, is located along Highway 165 southwest of Branson.

Nixon protects clean air by cracking down on open burning violators in lawsuits filed around the state

Residents of five Missouri counties who allegedly violated state clean air laws through open burning of commercial and demolition waste are facing legal action from Attorney General Jay Nixon. In the past six weeks, Nixon has filed lawsuits against defendants in Andrew, Audrain, Buchanan, Lafayette and Macon Counties to stop the illegal burning and obtain penalties for the state.

Nixon takes legal action against developers of subdivision near Hartsburg for erosion runoff

Attorney General Jay Nixon is seeking civil penalties and a court order because of erosion and sediment from a residential subdivision near Hartsburg that threatens to pollute a nearby stream. Nixon today filed a lawsuit in Boone County against Dana and Elizabeth Austin, the developers of the Ridge at Hart Creek, a 121-acre residential development site on Christian School Road.

Agreement to control methane from old landfills will allow Stone Canyon development to proceed safely, Nixon says

An agreement obtained by Attorney General Jay Nixon will address environmental concerns about methane gas at a residential and golf course development in Independence and allow the project to proceed safely. Under the consent decree filed today in Jackson County Circuit Court, Sailors-Woods Development LLC will take over The Links at Stone Canyon, the project being built partially on the site of two now-closed sanitary landfills.

Illegal installation of septic tanks leads judge to stop sale or development of homes at Dunklin County subdivision

A Dunklin County judge has ordered the developers of the Williams Landing subdivision north of Kennett to stop advertising, selling or developing homes at the subdivision. Attorney General Jay Nixon brought a lawsuit against Ronnie and Kimberly Williams after they illegally installed septic systems at homes in the 75-lot subdivision rather than connecting the homes to a centralized sewer system, as required by state regulations. The 35-acre subdivision is located at 20464 State Highway EE.

Owners of now-closed Shooters 21 pay $10,000 penalty, must correct environmental violations in order obtained by Nixon

The owners of Shooters 21, a now-closed restaurant and marina at the Lake of the Ozarks, have paid a $10,000 penalty and were required to take several actions to correct numerous past environmental problems under a consent judgment and permanent injunction obtained today by Attorney General Jay Nixon.

Nixon obtains order against Howell County dairy to prevent future violations of state clean water laws

A dairy operation in south central Missouri that was cited for violations of the state clean water law must comply with the law in the future and allow access to state regulators at all times to ensure compliance, Attorney General Jay Nixon said today. Howell County Circuit Judge David Paul Evans signed the Joint Preliminary Stipulation and Order against Bill Collins, owner/operator of Collins Dairy in Pottersville. Nixon filed a lawsuit against Collins last August.

Developer failed to control sediment run-off from two sites in Lincoln County, Nixon says in lawsuit

An O’Fallon development company failed to control run-off from two sites it is developing in Lincoln County, resulting in sediment polluting nearby streams, Attorney General Jay Nixon says. Nixon filed a lawsuit in Lincoln County this week against Triad Development Company for violations of the Missouri Clean Water Law at The Hamptons, an 88-acre commercial and residential development in Troy; and at Anna Meadows, a 48-acre residential subdivision south of Moscow Mills.

Nixon obtains judgment against salt company over violations of state clean water laws in Marceline

A salt company that violated Missouri Clean Water laws in the operation of its salt transfer facility in Marceline must upgrade its spill containment system, pay a $18,000 penalty and comply with all state environmental laws under a consent judgment obtained today by Attorney General Jay Nixon. The court order against Hutchinson Salt Company, which operates the salt transfer facility in a rail yard the company leases from Burlington Northern Santa Fe Railway, was filed today in Linn County Circuit Court.
