AG Nixon sues car extended "warranty" companies
How many of those mailings have come to your house that say your car warranty is about to expire?
AG Nixon just announced lawsuits and settlements with several companies in that business. The violations we're alleging:
- They mislead consumers into thinking their warranties are about to expire, when they're not. These companies don't know when your factory warranty expires.
- They mislead you into thinking they're with the manufacturer, when they're not. They're 3rd-party companies.
- They don't cover what they say they will.
- They fail to disclose important requirements - including one example where a consumer found out he had to use a certain brand of oil to get reimbursed for repairs.
Anybody selling these "extended service contracts" has to be registered with the Missouri Department of Insurance. If you're considering one of these companies, you can check with Insurance to see if they're registered at 1-800-726-7390 or here.
FYI, these are technically not warranties. That term applies to the free warranty that comes when you buy a product. These extended warranties should actually be called extended service contracts.

I am an Illinois resident and today received one of these mailings purporting to be from Dealer Services, 100 Mall Parkway, St. Louis, MO 63385. While I do see two records for Dealer Warranty Services, with a different address, on the Missouri Department of Insurance, Financial Institutions, and Professional Regulation website, I do not see an entry for Dealer Services. I note that Attorney General Nixon filed lawsuits against Dealer Warranty Services, of St. Charles, and National Dealers Warranty Inc., of St. Peters. Are you aware if Dealer Services is in any way affiliated with either of these companies; and if not, has the Attorney General also filed suit against this company, or does he plan to do so? The notice I received actually does contain a disclosure that provides, "If you do not wish to receive future offers, you may call out Opt-Out line at 1-800-699-7710. Dealer Services is not affiliated with any manufacturer or specific dealership. Calls may be recorded for quality purposes. Your use of our 800 number shall constitute your consent to have such calls recorded." but it's at the very bottom of the, otherwise completely blank, reverse/back side, in small print and squeezed into two lines. In my opinion, the letter is misleading because the heading is "Volkswagen Notification"; and they use language which, seems to me, to be an obvious attempt to deceive the consumer into thinking that they are somehow affiliated with an original warranty provider (Hoping that no one will notice the "concealed" little disclosure on the bottom back.) In any case, is it possible that you could upload and provide links to the complaints filed by the Attorney General? It would be great to know what the status of these cases currently are (i.e. have they been decided, appealed, etc.?)

I received the exact same letter as Tim and Libby. It starts as "GMC Notification." My vehicle isn't even a year old. There's a paragraph in the letter that states, "Due to the nature of this program, we can only authorize your vehicle for 72 hours from the receipt of this notice." I'm located in Texas.

got the same letter as above, headed Mazda Notification. address is 100 Mall Parkway, St. Louis, 63385. thankfully, I got it last week and just got around to opening my mail so my 72 hour deadline has expired and I won't be able to give them my money for whatever they are promoting which I don't need. (just kidding--I wouldn't have really given them money or taken the "interest free same as cash financing" they offer.) I hope you get them, but I know they'll just move on to another state or name and it won't stop them. What are the penalties for these folks who take advantage of us? how do we stop them?

They sold my father extended warranty policy over the phone. My father is deaf in one ear and hard of hearing in the other. They apparently sold it to him 4/2007. We have been trying to cancel policy since Feb. 08 when we had his car taken off the road when my Dad was hospitalized for 1-1/2 months. My father was declared legally blind in Oct 2007. Dealer Services has been giving us the royal runaround. The paperwork they sent my father contains the INCORRECT VIN number - I am sure this to be a tactic on their part to later refuse any services should they be required. Only 5,148 miles were put on his car prior to removable from the road and the sale of his car. He never submitted any claims. He was also verbally told he would be FULLY refunded if warranty was not used.

I got the same letter from Dealer Services, 100 Mall Parkway, St. Louis 63385. I was a sucker. In the process now if stopping the payment and getting another charge card number and filing with Texas AG.

I also received a letter headed Toyota Notification. Underneath that heading was a subheading listed as "Dealer Services", 100 Mall Parkway, St. Louis, MO 63885. I just bought a vehicle from Toyota one year ago and after confirming with them that I had a warranty till 2014, I called Dealer Services. When I talked to coverage specialist from Dealer and advised him that I already had coverage with Toyota, the specialist responded by saying "That's a bunch of crap". I couldn't beleive such a response." This only reconfirmed the fact that this company may not be legitimate. When I questioned the specialist further on the phone, he was evasive and rude. As a result the gentlemen hung up on me for complaning of his rudeness. I called back later to advise them to take my name off of their list and to not send me any more letters. They directed me to the Opt Line which was 1 800 699 7710. I called that # and requested my name to be removed. I didn't feel comfortable about this company at all. That is why I contacted my Dealer; Toyota. They advised me that they had no ties with this company whatsoever.

I got the same letter. My car is out of warranty. I'm a former car salesman, I believed this to be a SCAM from the get go. If you have given them any monies please contact your AG. BUYER BEWARE!!!!

I have gotten letter after letter from this company since I purchased my car nearly two years ago. Luckily, I haven't fallen into their deceitful tactics. Nor do I have the money to purchase a warranty for my car, anyhow. In response to Carol's comment, the dealerships must have some sort of tie with this company because Dealer Services knows what type of vehicle we all drive. In her case, she had a Toyota letterhead, and in mine, the Pontiac letterhead is correct, and there is even a stock photo of my car. These letters have always seemed fishy, and the only information that can be found online about "Dealer Services" seems to be on consumer complaint pages. Great job, A.G.'s Office, in protecting other legit businesses in your state by filtering out the scum.

These guys are weasels from the get-go... two different MO-postmarked letters using two different company names ("Warranty Activation Headquarters" and "Service Protection Program"), plus the violated the Do Not Call act with a robot call this evening calling themselves "Warranty Services Company" - and a fictitious name and phone number on caller ID. Can folks get in on the (hopeful) class action that these cretins deserve?

Purchased the warranty for my 2003 G35 in April of 2008...on the phone the gentleman promised me multiple times that all labor costs would be covered and only new parts used. Lo and behold I took my car in for repair and they will only cover up to national average. I am meeting with an attorney tomorrow for false advertising.

Today 24 June 2008, I received a letter in the mail from Toyota Notification, Dealers Services, 100 Mall Parkway St Louis MO, informing me that my 2005 Toyota warranty had expired which was true and offered me an extension. The first indication of a problem happened when the letter I received stated 2005 Toyota and on the phone they were saying 2006 Toyota. Now the price of the extended warranty I felt was very high and started me to wondering. After going over the payment with the representative, I tolg him this cost was too much for a Toyota. I told him a Toyota is a well put together car and should not require that much maintanence for what they were charging. After I told the representative that I was going to talk to someone else about this, he became concerned and informed me that if I hung up without a deal then the offer was off the table...I told him BYE. I don't trust this company, I can smell a dead cat on the line somewhere.

I live in Utah and have also received letter after letter, all from MO. My home and business phones continue to ring off the hook with the same offers. I've requested that my numbers be added to their do not call list, but the calls continue. When questioned, the agents are rude and will always hang up. I wish someone could do something about this.

Just received one today from Service Protection Program, 300 North Tucker, St. Louis, MO. I live in Texas; my car is a 2001 Volvo, which went off Volvo Extended Warranty a YEAR ago. Does the Missouri AG want a copy of the letter? Will be glad to send it. I'm also getting calls AT MY OFFICE from these folks.

I called this company today to ask about their warranty and within 5 min. they were asking if I would pay with Visa or Mastercard! I told them I was just getting information so I can make a decision as to whether I would even want to keep my car or buy a new one, but they were determined to make the sale. First they told me it would be $3855 for 4yrs/100,000 miles and then when I didn't take it they transferred me to someone else who lowered it to $3250 and finally, they transferred me to someone who was "giving it to me for the price they pay which was $2936." Within 20 min. I was given three quotes! I didn't even care about the price because I was just calling for info and each time they would ask, "will you be putting this on a Visa, Mastercard or Discover." They didn't want me to hang up; it was ridiculous. First of all, my car is still under CPO warranty and they didn't even know that and they kept telling me that if I wanted to call back later the offer would be off the table. They said that they don't know if I am going to call back when my car needs repair or something along those lines. I then told him that I don't really want to associate with a company that is so suspicious and untrusting before I am even a customer, and that I wonder if they are going to give me a hard time when I try and make a claim. Not only that, I'm not about to just give my CC info to someone who sent me a letter without directing me to their website or offering me more information, especially with all the scams going on nowadays!! I got a real bad vibe from them and the call ended when the frustrated rep just said "fine bye" and hung up.

I just received this letter in the mail. I usually ignore these letters and let the warranty expire, but what I noticed was it was for a 2003 Hyundai. Unfortunately, I don't have a 2003 Hyundai at all ('06 Explorer). Now I am on the phone with Experian to get my credit report to ensure no one stole my identity. What a hassle!

I just received this letter from Dealer Services 100 Mall Parkway, St. Louis, MO 63385. They claimed my warranty on my 2004 Ford has expired. I dont own a 2004 Ford. I dont even own a FORD. I havent called them yet, but I am going to call them and give them a bunch of grief. I'll let you know how it goes. This company doesn't sound very legitimate from my personal experience and all that I have read from everybody else. DONT GIVE THESE PEOPLE ANY MONEY!

I got a letter from these crooks, too, and was going to ignore it since I know my original warranty is still valid. What concerned me was the fact that the letter told me my "2003 Honda" warranty would soon expire. I don't own a Honda and never have, and was concerned about identity theft. When I called, they explained that they got their information from "many sources" and that there had been some "computer glitches" lately, so they were sorry about that, and... did I want to get a warranty for my current car? Amazing. Somebody needs to arrest these people and put them behind bars for a few years.

I just recieved a letter from these same people with a vehicle that I do not own (2002 Buick). I called twice and each time that I asked how they got my information and how they got the information that I owned the referenced car, the same excuses as Catherine came up and the phoneline suddenly went dead. I was wanting to make sure that there was not an identity theft issue that I was about to have to start dealing with. Finally called again and asked for a supervisor and an extention number for future reference and was told that all the managers are on the floor and do not have extenstions. I then asked for Kent Finley's extenstion and was hung up on again. Stay very far away from these people.

I just received the "letter" from Dealer Services with a Dodge Notification header. It was indicating factory warranty on my 2007 Dodge has expired or may be expiring soon. I already have an extended plan via the dealer that includes pre pay service visits. The van is well within its warranty. This is an excellent web site as I was searching for information regarding the company. Thanks

I received a letter today..same thing. I had gotten phone calls from them before and told them "no"...then they called again..and I had gotten rid of the car they had called about...and I told them I don't have that car anymore...and asked them where they got my information and who they were affiliated with and the lady hung up...it was pretty obvious from the get-go that they were a scam. The letter today is regarding my new car...which thankfully, has quite a warranty package with it. Another thing I have noticed about them is that they don't abide by the do not call list...like others here have said. In addition, to the person that thought they had ties to the car dealerships...actually, they can get this information through public records- DMV....

I live in TX. Just got a letter from "Ford Notification - Dealer Services"... 100 Mall Parkway, St. Louis, MO. Signed Kent Finley, Senior V.P. They're telling me I have 72 hours to jump in on this great extended auto warranty for my 2005 car that has had no warranty for 20,000 miles now. I need to call them immediately with my mileage, , VIN # and customer ID #. Yeah... I don't think so! Can we all just say - SCAM??

I am getting several calls a week from a stern recorded voice that says my factory warranty (I've never had one) was going to expire and this was my last call. I've asked to be removed from the list several times, and I signed up the DNC registry just to get rid of them. I would prefer mailings! These calls interrupt me and upset me! Any hints on how to stop the calls?!? Today I asked 'Gary' for his ph# and co name bc I would have to call him back, and he hung up on me.

I received a similar letter from "Dealer Services" stating my factory warranty has expired or may expire soon. I reversed searched their phone number online, and was told the number did not exist.... I wonder where they get their list? I have had my care 5 months. Obviously, my car's factory warranty is in full effect. I plan to call them and hang up on them after I say what I have to say. I have no time for slime. I also plan to call my dealer....

i don't get letters i get phone calls as many as 5 a day. they are about to drive my wife and me crazy. it is a recorded message and there is no way to talk to them. i am fed up and need help. my wife and i are old and disabled and don't need this kind of crap. besides our vehicles are junk and would not qualify for any kind of warranty. somebody help me, richard

These people keep sending my mother cards. She has never owned a vehicle in her life. She even wrote them a letter telling then this. She also told them they were scammers. She got back a letter thelling her that they were not scammers and would thak her off there list. They didn't MR NIXON Put someone in JAIL.

I have received COUNTLESS letters from these scam artists. I am registered with the "Reduce the Hail of Junk Mail" (similar to the "Do Not Call List") but these obnoxious people refuse to abide by any rules. I find it very disappointing that nobody has been able to stop this constant harrassment. FYI - Company's like this get our personal car information directly from the State DMV Office!!

i have gotten a letter today also about the warranty on my nissan. call them immediatley and i only have 72 hours to do this. i have also recieved a call at 7:00 durning supper about a 2007 calorda warranty that my husband had told them friday we did't have, the calls are all unknown. i felt like this was a scam b/c of the phone calls that we are recieving about warranties and credit card services when we do not have any cards.

We got one of these letters in the mail and it has a picture of the kind of car i have. I saw the note on the back in fine print.When you call the # on the back in fine print, they want you to give them your adress id #, and your name to be removed from their list and Iam afraid to do that in fear that it may activate something. HELP!!!

I feel vulnerable after talking to them for even just 3 minutes. Like others, I received the letter both before and after my warranty expired. I knew it was an outside company, but I figured I'd call just to see what they'd offer. I first spoke to a chipper lady who asked me for my VIN# and I refused to give it to her. Then she asked for my customer ID and I said I just want to know the cost for my type of vehicle and started lecturing me about how they could get the VIN# and other information from other sources if they wanted to. Just to shut her up I gave her my ID. Then she said, "In case we get disconnected can I call you at this numer" and then she repeated my phone number to me. I was wondering where she got it and now I'm not as concerned with that, but more with when I will start getting their phone calls trying to sell me. I told her it was the correct phone number. Then, she asked me for the make, model, year and mileage on my car. When she found out I was over she put me on hold to "check w/ her supervisor". Of course she came back and said "good news - he approved". Then I was transferred to this uber annoying guy who wouldn't let me off the phone after he quoted me over $3,000. I just feel worried now that I exposed my name, address, phone, occupation, etc. Beware!

I received Toyota Owner Notification letter. The first one wasn't even the same year as my car. I called my husband and told him about it and he called them and told them to remove my name and address. However, I have received another letter from them. The problem with their price solutions to fix a car like mine is thousands of dollers......I didn't even pay that much for my car. My car is a 96. Somebody like my grandmother would fall for this and agree to the warranty.

We received a letter about our Ford F-250, that sounds exactly like one that everyone else has gotten. Now, we don't usually call these things, but this one SEEMED to be Ford Affiliated. I called to get more information. Before I was even transferred to someone who could give a price quote, the guy was asking if I could make a decision on the spot and what credit card I would be using!! I said I just wanted information, so that we could make a decision and he informed me that "they didn't want people calling back after the vehicle breaks down", etc. etc. Then he patched me through to a guy who gave me a quote and then high-presssured me to make a decsion. When I didn't bite, he lowered the price on the spot! I told him that I had to talk with my husband. He told me that "once our information was put into their computer and not purchased, it would be kicked out of their system and the offer would not be available. I asked him for a list of coverages (in writing) before making our decision and was told they don't have a Fax. A legitimate company with no fax?? I then asked for a website to look at and he wouldn't give me one. After ll of that, I smelled a huge rat! I told him that I was not going to make a decision today. The guy that had been so cordial, suddenly became rude and defensive. I got online and found numerous complaints and lawsuits against them. Someone PLEASE put these jerks out of business! Thankfully, we didn't fall victim, but it would be easy to do so. I am saving this letter, if any one would like to have a copy to compare to.

I just got a letter from Service Protection Program of St. Louis. I'm not biting, but if there is any kind of action against these people, I'll gladly be a part of it. What I've done is set up a savings account with regular monthly deposits to self-insure against a big maintenance bill.

Just got another CARD from another SCAMMER in Missouri. How many of these SCAMMERS are there in Missouri? When Will Mr. Nixon put these people out of business. Have gotten four cards / letters in the last week from: Dealer Warranty Services DWS, LLS same as Dealer Warranty Services Dealer Warranty Dealer Services All from the same area by the zip code. Plus I lost count of the ones I have shredded from the same SCAMMERS. When I called Dealer Warranty Services got a Person name LANCE if that was his real name. I ask why they keep sent cards after being asked to stop. I told him he was working for SCAMMERS. Then I told him to look up DWS on the Internet and he see. He said they were not SCAMMERS and the BBB was a bunch of liars. I never said anything about the BBB. Now I got to go look them up.

I really need some help here. I've been stupid and thought that this was legit and so I purchased it. However, I'm supposed to be paying them monthly. In the first month I paid them $150 dated 11/10/2008 and I called them up today to cancel it after looking at all the complaints online. How can I stop future payments to them. The cancellation policy involves sending them my name and address on a slip of paper, along with the mileage reading notorized and signed by me. How will I ever get a confirmation of sending these materials. I'm really really worried here...and I'd appreciate any help from anyone on this forum who could help me. Please Please help. Can I close my bank account...will that affect me legally? How do I just stop future payments...they say I have to pay 10% of the total amount to cancel! Please help...

You need to consult your contract with the company to determine the cancellation policy. Normally with insurance policies that you pay monthly, you can stop paying and your coverage simply ends. But again, you should check this. If you need further help, you can file a consumer complaint with our office. For the link, see my response to Teri above.

Thank you for your prompt reply. I had paid them on the tenth of november for 150 dollars and they didn't send me my so called warranty papers yet which is why i was a bit suspicious. I called them up and asked them for my policy number in case something goes wrong before I receive my papers and they replied saying well if something goes wrong then we'll give it to you. At this point i knew something was up. I returned to my cubicle at work and opened up a pandoras box of complaints. I'd been duped and I was determined to resolve it immediately. I called them up and said I wanted it cancelled this instant. He informed me the cancellation policy required me to pay 10 percent of the amount along with sending in my name and address on a slip of paper and a notorized odometer reading with my signature against it! Also they wanted me to send a book back which apparently is supposed to be in my alleged warranty package (i havent received it yet). I can't even close their fake policy because they havent provided me the documents. I would like to know if there is any legal complication I could get into if I didn't pay! Could they even go to court considering they're fakes? This is their phone number 8663387877 and I know they're located in missouri...I'm worried even more as I'm an international student presently working here and I don't want my credit to be affected or to lose my money. I called them up again this afternoon and I asked them for website. They provided me with warrantyservices.net. The person I spoke with told me to wait 9-14 biz days until I received the warranty papers. He asked me to then turn it in along with the things I mentioned earlier. There seems no immediate end to this. I really want to be done with this right now and they won't allow me. I do not want to spend another dime. When I said there was no recorded agreement telling me or explaining to me the terms and conditions, he said do you think you're the only person out of 1000's that doesn't have one. I want out now...i'm worried!

So glad to know that I have been right all along. We bought a brand new Dodge Ram just about two years ago and have been getting this same letter from a few different addresses in St. Louis. We got a three-year warranty on the truck and have upgraded to a lifetime warranty from Dodge. I assume it is that same bunch that has called several times trying to scam me. When we got the first letter, I called the Dodge garage we bought from and asked if it came from them. Of course, it hadn't. So, I DID call the # and pretended I was interested by answering some of their questions. Then I asked them why I should need to buy a warranty then (one year after we purchased the Ram) instead of waiting until it was almost expired. He had some line about needing to get it taken care of so it is done when the warranty runs out and then, of course, jumped right into getting payment information. How stupid did he think I was?!!! As I went on telling him I thought it was a scam, he hung up on me. Now, just today I have gotten yet another call from a place which I am assuming is the same as the one we get the letters from. When it said to push one to talk to a rep, I did that. He started by asking my make and model and I told him that he didn't need that b/c this is one of the biggest scams I've ever been involved in. He immediately hung up! CAN THIS PLACE BE PUT IN JAIL FOR ALL THIS?!!!! PLEASE!!!

I find all this quite fascinating since I come from the warranty industry. Not all warranties are the same and yes some are out for a quick dollar....The company I work for is listed with the BBB and have a been ok'd by the Mo attorney genneral for doing things the right way....Cancellation procedures are diffrent depending on the company that provides the warranty..Most policies offer a 30 day money back guarantee unless it is a product warranty which carries a 50.00 cancellation agreement..Companies like the one I work for have to suffer because of the ones who practice improperly...I have been selling warranties for 4 years and if its done correctly with the right underwriters then yes they can save you lots of money...For those of you who do not listen or understand what the qualified reps tell you then unfortunately thats not our fault...Our office records all calls not only to protect ourselves from lieing customers who say they do not have issues with their car ( and 3 days later try to file a fraudulant claim)but also protect our clients from reps giving them false information, so it works both ways. And for th4 lady Karen above, DOdge truly has no lifetime warranty...Read the stipulations on the policy. Its just powertrain and then the stipulations on that policy our pathetic....Why does no one complain about the dealers selling 2000.00 warranties at the time of purchase? They sell you a 4 yr policy knowing your vehicle is already covered for 3 yrs....so whos the crook here..if i sell you a policy with 6 months left on your current warranty at least i give you the full 4 yr additional not retro back to the inservice date of the vehicle....The legit warranty companies will normally send you a letter...The phone calls our coming from random phone dialers hoping to catch someone close to their expiration date of the warranty..Those are the scammers...

Letter today from Dealer Services with the same spiel about the 72 hours. Final Notice, it says. How would they know what I have? I've owned this '91 Ford for a few years. Only vehicle. Certainly no one would warrant this vehicle. These people need some jail time to get their thinking straight. They are out to trick and scam old folks, who can't think this thru.

I ONLY WONDER HOW MORE ARE ACTUALLY TRICKED INTO THINKING THAT IT IS A MANUFACTURER CONTACT! As it so happens, i had no idea about this whole dealer's warranty, so when someone had contacted me possing to be Diehl Toyota, I believed them. Little did I know this was infact a fradulent company...contacting me first from a 1-702-520-1185 number...by the time the initial sales reps story didn't make sense..it was to late.My bank account was infact emptied out, I asked to then cancel my policy...and was then directed to call 1-866-338-7877..so i did so. Upon asking to cancel I WAS HUNG UP ON......so I called again, then I was told someone would call me back. Please if any assistance is needed to correct this problem, i will help in anyway I can with all the information I have.

Travis: like other posters here, I've received and continue to receive MANY unsolicited mailings from these "extended warranty" companies in Missouri (I live in FL). One recent offer claimed they knew when my last service was, and with a certain dealer. Where are they getting our personal information from so we can close that loophole and keep them from contacting us? And by the way, is it any wonder many Americans want a "Do Not Mail" list, too. Thanks.

These comments have been ongoing for almost a year! I thought these scammers were being sued? How/why are they still doing "business as usual?" Got a call from them today (at work) and see that they've simply changed their address to West Palm Beach in Florida!! Guess I misunderstood the AG's motive here (to help the public).

I have also received several notices in the mail, which I have destroyed. My number is unlisted and I have received numerous recordings regarding a warranty that is about to expire. One day I did answer the phone and a live person was on the line. She immediately asked me the year and make of my vehicle, which I did not tell her. As soon as I asked the name of her company, she hung up. You know it's bogus when they hang up. If they were a legitimate company they would be willing to give you their name. I do not have caller id so I'm not sure where the call originated from. I did dial *69 and nothing came up. I would just like to know how to get these callers to stop harassing me at home. Thank you very much.

The previous attorney general got settlements with two of these companies: Certified Auto Warranty Services and National Dealers Warranty. In the others, are lawsuits are moving ahead. We can not simply shut down a company without a judge's order. That is the purpose of the lawsuit - to get a judge to order changes in the way these companies do business.

I filter all comments and remove them for advertising and obscenity. In some cases, these comments are otherwise informative, so I just edit out the sales pitch or obscenity and post the rest. We got a lot of spam, but other than that, most comments are good.

Hello, I purchased an extended warranty from Dealers Warranty before doing proper research. I canceled the warranty over the phone the same day. I was assured I would get a refund for the "down payment". I think I will never see that money. I canceled the credit card and told my bank. They said I will have to file a dispute with Visa. Is there anything else I can do? Thanks!

This is funny. I got the post card earlier this year and today got a call about an "Extended Warranty Program" (Yeah right) and an end-of-the-day pressure tactic to buy their service. I smelled the scam 2 seconds into the call. I hardly gave the dude a chance to sell me anything by reading them the riot act with reverse questioning then hung up when the guy mentioned the agreement would not be valid by the end of the day. Don't Fall for thier BS. Question everybody hard who tries to sell you anything under pressure or in a suspicious manner.
