Fraud against businesses - they're consumers too
I recently gave a talk at a seminar for small business owners, reminding them that they are consumers as well. Anyone who pays bills, hires vendors, signs contracts for services, etc, is a consumer.
So that means they can be victims of fraud, and they can file consumer complaints with our office. We filed around 60 lawsuits in consumer cases in 2007, and 15 of those involved businesses as a victims. Highlights of the last couple of years:
- Yellow-page companies sent checks for small amounts to companies. When cashed, these activation checks obligated the business to an online yellow-page ad they didn't want or even know about.
- Junk fax company busted for sending faxes to businesses. Sending unsolicited faxes is illegal.
- Company charging businesses for posters that say "Employees must wash hands." All such required government posters can be obtained for free from government agencies (OSHA, Family Medical Leave Act, employment rights, etc)
- Company charged businesses to build Web sites and didn't deliver.
- Another company charged for Internet advertising and didn't deliver.
- Company grossly overcharged businesses for credit card processing machines.
- Fire extinguisher inspectors who didn't perform. 2 different inspection companies left a lot of businesses not only ripped off but in grave danger of fire. This one could have lots of victims we don't know about yet.

There is a business owner located in Missouri that has stolen services from me and has not paid me for those services, dating as far back as September, 2006, an d amounting to a total of $4,090.00. I filed a small claim against the owner in Howell County and received a default judgment of $3,00 plus costs of $65.00. The owner still refuses to pay. I went to the Howell County Sheriff's Department to file a complaint, as I understand that Theft of Services in Missouri in amount of $500.00 or more is a class C Felony. My information was taken, but the owner still has not been arrested, and charged with Theft of Services. The owner resides in West Plains, MO.
Can the Attorney General's Office provide me with any information or assistance in how I can have the person charged in State Court for Theft of Services.
According to information I have received, this person and his business is the major topic of conversation on Yahoo Groups, Professional Pilot Car Group.
I reside in Tennessee, some 369 miles from West Plains, and at least two of the jobs involved with the trucks traveling through the state of Missouri.
Please let me know if the State Attorney General can help me. I performed the contract work with good faith and this criminal refuses to pay me for them, though his wife visits gambling casinos regularly and this person owns several very expensive vehicles.
