Top Ten Consumer Complaints in 2007
Last week, our office announced its annual "Top 10" list of consumer complaint categories. Here is that list again along with some helpful links that will give you tips on how to recognize and avoid becoming another victim of consumer fraud:
- Financing, credit, and debt collection
- Auto sales, repair, odometer fraud, title and towing
- Gasoline prices and storm-related price-gouging
- Telephone slamming, cramming and billing
- Home repair and remodeling
- Lotteries and sweepstakes
- Identity Theft
- Travel Clubs, timeshares and travel related promotions
- Computer software, online services and internet auctions
- Charitable organizations

I wanted to talk to someone to understand what my rights are. In May 2005 my husband and I bought a house in Raytown Missouri, we were told by the owner and the real estate agent that they were sailing this house to us below what the appraised value and that there was not a house in our area like this with a pool and jacuzzi. The owner told us the house was appraised for 150,000 and that he would sale it to us for 147000 and he would live the pool and jacuzzi as if he could have took the pool anyway. The real estate agent told us she would let us see the appraisal on the day of the signing which she did not. We have been staying in our home for 2.5 yrs now and our mortgage is scheduled to go up in May because of an adjustable mortgage that the real estate agent who was also the broker never told us about. We found this out at the signing but it was never explained what it was and the agent was not present nor was the owner of the home at the signing it was with a third party company. We just found out about the adjustable mortgage and what it was about a year ago and have been trying to refinance our home to get a fixed rate and have been told by new lenders that we are upside down in our home and that the homes in our area are only about 126000 and have not been able to find anyone to refinance us. Is there anything we can do because of the shady broker/agent and home owners. I think we are going to lose our home and if knowing everything that we know now we would have shopped around for a better deal instead of being swindled. Is there any law that protect us? Not to mention the brooker sent us a letter after we signed and wanted us to date to the day of signing and say that we refused the termite inspection which we didn't and didn't even know that this was something we were supposed to have. I don't know if this even means anything but I just wanted you to see the shady dealings of the broker.

You have three options to explore, the first two of which are free:
1. File a consumer complaint with our office.
2. File a complaint with the Missouri Real Estate Commission.
3. Hire a lawyer.

We could use a system like this to deal with underhanded agents, buyers and sellers in our Woodstock Real Estate market.
