Mastercard-Visa-Diners Club class action lawsuit - legitimate
Credit cardholders with these three companies are getting letters in the mail inviting them to participate in a class-action lawsuit. Some Missouri consumers are calling our office asking about this and whether it's legitimate. It is. The lawsuit has to do with the fees the cards charge to convert foreign currency. It alleges the three card companies conspired when setting their fees and did not do a good job of disclosing them to consumers. You can find out more about the lawsuit here.

So, you don't directly say, but seem to imply that this is legitimate. Is it legitimate?

Yes, it is legit, though the paragraph above is somewhat incorrect. First, there is no invitation to "join" a class action suit, since one does not "join" a suit- they are automatically part of it. Under the Federal Rules of Civil Procedure, Rule 23, a person can only "opt-out" of a class action suit, and if no measure is taken to opt-out, then they will be included in the suit. Secondly, this letter sent out is not regarding the suit itself, but the settlement. In other words, the suit is over, the money is on the table, and people just need to claim it.
So go ahead and file that paperwork - you'll get at least 25 dollars from it.

I spent 25 weeks overseas and did not file by deadline. Is there any way to file still?

To Kat:
You will need to ask the organizers of this lawsuit (which is not our office). Follow the link in the original blog post above and submit your question under the Contact section of the Web site.
